تقسیمِ میراث کے منتخب اختلافی مسائل: اہلِ سنت اور واہلِ تشیع کا تقابلی جائزہ "Inheritance Division: A Comparative Analysis of Selected Differences Between Sunni and Shia Perspectives" Section Islamic Literature

Abstract

Islam presents a complete code of life for all human and Jin, which guides us about every aspect of life. And the basic book of Islam i.e. the Holy Quran and Sunnah provides a complete solution of all of our problems. As Islam is revealed to protect five things of human and Jin and these are belief, health, mind, race and wealth. To carry on peace to this life, Islam has focused on the equal distribution of wealth amongst the followers according to their capabilities, honor and responsibilities. One of these kinds of distribution is the system of distribution of inheritance. In Surah Al-Nisaa Allah Almighty has explained the laws of inheritance which cover about all aspects of inheritance. This is the only topic of Quran which is explained thoroughly, giving rights to all the deserving heirs of a dead person, but there are jurisprudential issues regarding laws of inheritance which may differ from one another according to two sects of Muslims .i.e. Sunni and Shi’a. These paragraphs discuss took some selected controversial issues of inheritance between Sunni and Shi’a schools of thought, which were elaborate in a research manner and its impact regarding jurisprudential side.  This article also describes the reasons that how much a relative will get from his nearby heirs. Problems of distribution of the property of heirs are mentioned, after which, their solutions are explained according to their respective sects. At the end a comparison of laws of inheritance of both the sects is given. We hope that study will open new areas of research for the upcoming researchers and will make the readers know about the real and accurate solution of the below mentioned issues of inheritance. And will drag a line wherefrom the scholars and researcher will start their journey of solving of such problem.
