Abstract

The principal purpose of this thesis is to examine the religious obligations and legal considerations (Fiqah) related to the deaf community, grounded in Islamic Shariah, while also addressing their beliefs, rituals, and social issues. Although societal challenges, such as discrimination and social marginalization, are considered, the primary focus remains on interpreting Islamic jurisprudence specific to the deaf community. Referencing primary sources from Hadees (Prophetic traditions) and Fiqh (Islamic jurisprudence), particularly from the Hanafi school of thought (Fiqah-e-Ahnaf), the study seeks to carve out a feasible legal and societal framework under Shariah to enable the deaf community to function on an equitable basis. This framework is intended to facilitate their integration into society without exclusion.


This research holds special significance as the first comprehensive work dedicated to addressing Shariah issues unique to the deaf, presenting practical, religiously rooted solutions. The findings also reveal untapped potential for further scholarly work to support and integrate people with disabilities within the scope of Islamic law. The thesis thus represents a novel effort to address the intersection of disability, religious obligations, and social rights within the enabling framework of Shariah, contributing to a deeper understanding of Islamic thought in relation to the rights of individuals with disabilities.
